1. Purpose

This document outlines the Terms of Use and Privacy Policy for Erikar Service (the “Service”), a Push-to-Talk (PTT) and real-time location tracking platform provided by Erikar to authorized partner organizations for their internal operational use.

2. Account Creation and Access

• User accounts are created and managed by the organization’s designated administrator using the tools provided by Erikar.
• No public sign-up or self-registration is available.
• Each user account is tied to an organization and cannot be transferred or shared outside of it.

3. Location Tracking

• The Service requires continuous access to GPS location data, including background access, to enable real-time communication and user coordination.
• Users must grant “Allow all the time” permission in system settings to ensure proper functionality.
• Denying or revoking this permission may render the Service inoperable.

4. Data Collected

Erikar Service does not collect data directly from users. All user data is entered and managed by the partner organization. The data includes:

No sensitive financial, biometric, or health information is collected.

5. Purpose of Use

User data is processed solely for the operational needs of the partner organization, such as:

• Assigning and managing internal communication
• Coordinating field activities in real time
• Monitoring operational safety and availability

Erikar Service does not use, repurpose, or share this data outside the scope of the contracted service.

6. Data Retention and Deletion

• User data is deleted within 90 days after the organization deactivates the account or upon contract termination.
• Real-time GPS data is not permanently stored unless required for audit or technical diagnostics.
• Limited logs may be retained in anonymized form for legal or technical reasons.

7. User Responsibilities

• Users must operate the Service in compliance with the organization’s internal policies and local laws.
• Modifying system settings, disabling permissions, or attempting to circumvent communication flow is strictly prohibited.
• Any errors or malfunctions must be reported to the organization’s administrator.

8. Disclaimer

The Service is provided “as is.”
Erikar is not responsible for service disruption caused by device malfunction, denied permissions, GPS interference, or network limitations.
Location accuracy depends on device capabilities and environmental conditions.

9. Consent to Location Access

By installing and using the app, users consent to the continuous collection of their location data for the operational purposes outlined above.
A location access notice is presented within the app before requesting system permissions. Granting background location access (“Allow all the time”) is required to proceed.

10. Governing Law

This document is governed by the laws of the State of New York, USA.
Any legal disputes shall be resolved through the courts of competent jurisdiction in New York State.

11. Responsibility for User Data

All user data is created, managed, and controlled by the partner organization.
Erikar acts solely as a technology provider and data processor under the instruction of the organization.
In the event of any misuse, inaccuracy, or illegal handling of data, the organization bears full legal and operational responsibility.
The organization agrees to indemnify and hold Erikar harmless from any liability, cost, or damage arising from its use or mismanagement of user data.

12. Organizational Access and Binding Agreement

• Access to Erikar Service is granted exclusively to partner organizations upon execution of a signed service agreement with Erikar.
• Once the agreement is in place, the organization will receive one or more administrator accounts. These accounts allow the organization to register and manage its own users.
• By activating the administrator account, the organization confirms that it has read, understood, and accepted this Terms of Use and Privacy Policy.
• These Terms shall remain in effect throughout the duration of the organization’s service contract with Erikar.

By using the Service, both organizations and users confirm that they understand and accept the policies and responsibilities outlined in this document.
